By engaging Invulnerable for any services, whether through submitting an enquiry, booking a free audit, accepting a proposal, or making a payment, you agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with an engagement. These terms apply to all clients regardless of how the engagement was initiated.
Our Services
Invulnerable provides AI and automation consulting services to businesses. This includes, but is not limited to, workflow automation design and implementation, integration of third-party platforms and tools such as Zapier, Make, n8n, and Power Automate, AI agent development and deployment, CRM and communications automation, document and invoicing automation, custom scripting and API integrations, and automation audits and strategy consulting. Specific deliverables for each engagement are agreed upon in a written scope or proposal prior to work commencing.
How Engagements Work
Our engagements follow three stages. First, a free discovery call where we learn about your business, tools, and bottlenecks with no preparation required from you. Second, we provide a written proposal outlining what we will build, the platforms involved, and the fixed project fee. You must review and confirm this scope before we proceed. Third, upon receipt of full payment, we build and test all automations and then export or rebuild them on your platforms.
All engagements are project-based with a single fixed fee. There are no subscriptions or recurring charges unless you separately opt into a maintenance arrangement.
Scope and Client Responsibilities
The quality and accuracy of what we build depends on the information you provide. By engaging us, you agree to provide accurate, complete, and timely information when requested, review and formally confirm the proposed scope of work in writing before payment is made, provide access to any tools, platforms, credentials, or accounts necessary to complete the work, respond to requests for feedback or approvals within a reasonable timeframe, and notify us promptly if any information you have provided changes.
The agreed scope is the basis for what we build. If the scope changes after payment, additional work outside the original scope may require a separate agreement and additional fee. We will always communicate this before proceeding with any out-of-scope work.
Invulnerable is not liable for errors, delays, or suboptimal outcomes that result from inaccurate, incomplete, or late information provided by the client.
Payment
All projects are charged as a single fixed upfront payment. Work does not commence until full payment has been received. The total fee will be clearly stated in your project proposal. By making payment, you confirm that you have reviewed and agreed to the proposed scope and these terms. We reserve the right to withhold delivery of any materials or access to completed automations until payment has cleared in full.
No Refunds
All payments are final and non-refundable once made. By submitting payment, you acknowledge and accept this policy. Because our work is custom-built to your specific requirements and commences immediately upon payment, we do not offer refunds under any circumstances once payment has been received.
If you have concerns about a project outcome, we encourage you to raise them with us directly. We are committed to delivering quality work and will work with you in good faith to resolve legitimate issues within the agreed scope.
This no-refund policy does not affect any rights you may have under Australian Consumer Law that cannot be excluded.
Build and Delivery Process
All automations and workflows are built and tested on Invulnerable's own internal platforms before being delivered to you. Once payment is received and the build is complete, we export or rebuild the automation on your nominated platforms and hand everything over.
Delivery timelines are provided in your project proposal and are estimates. They may be affected by your responsiveness, access to required tools, and the complexity of the build. We will communicate any delays proactively.
Invulnerable is not responsible for delays caused by third-party platform outages, API changes, or your failure to provide necessary access or information in a timely manner.
Ownership of Deliverables
Upon receipt of full payment, you own all deliverables produced by Invulnerable for your project, including all automation workflows, scripts, configurations, and any other materials created specifically for your engagement. We retain no ongoing ownership, licence, or rights over the work delivered to you. You are free to use, modify, and build upon the deliverables as you see fit.
Invulnerable retains the right to use general methodologies and techniques developed during the course of your project in future work for other clients, provided no confidential information is disclosed.
Ongoing Maintenance
Our standard engagements are one-off projects. We do not automatically provide ongoing support or maintenance after delivery. If you would like ongoing support, for example to handle platform updates, build additional automations, or troubleshoot issues, you are welcome to discuss a separate maintenance arrangement with us, subject to its own agreement and pricing.
Invulnerable is not responsible for automations breaking due to changes made by third-party platforms after delivery.
Third-Party Platforms and Tools
Our services involve third-party automation platforms and APIs. Your use of these platforms is subject to each platform's own terms of service and pricing. Invulnerable is not affiliated with or responsible for any third-party platforms and is not liable for any costs, outages, limitations, or disruptions caused by them. You are responsible for maintaining any accounts or subscriptions required to run your automations after delivery.
Limitation of Liability
To the maximum extent permitted by Australian law, Invulnerable's total liability to you for any claim is limited to the total amount paid by you for the specific project to which the claim relates. We are not liable for any indirect, incidental, or consequential loss, including loss of profits or revenue, loss of data, business interruption, outcomes resulting from inaccurate client-provided information, or disruptions caused by third-party platform changes.
We make no guarantee of specific business outcomes such as increased sales, leads, or efficiency gains. Results depend on many factors outside our control.
Acceptable Use
You agree to use our services and deliverables only for lawful purposes. You must not use automations built by Invulnerable to send unsolicited bulk communications, engage in deceptive or fraudulent activity, violate any individual's privacy rights, breach the terms of service of any third-party platform, or facilitate any unlawful activity. You indemnify us against any claims arising from unlawful or improper use of our deliverables.
Confidentiality
We treat all client information as confidential and will not disclose it to third parties except where required to complete your project. Similarly, you agree to keep confidential any proprietary processes or internal information shared with you by Invulnerable during an engagement.
Termination
Because all projects are paid upfront and non-refundable, there is no ongoing contract to cancel. Invulnerable reserves the right to decline or discontinue an engagement if a client behaves in an abusive, unreasonable, or terms-violating manner. No refund will be issued for work already commenced.
Changes to These Terms
Invulnerable may update these terms from time to time. The latest version will always be available on our website. The version in effect at the time of your payment applies to your engagement.
Governing Law
These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of Australian courts. Nothing in these terms limits any rights you may have under Australian Consumer Law.
